The Court of Arbitration for Sport (CAS) has dismissed an urgent request for provisional measures filed yesterday by CA Boca Juniors in which it sought to suspend the second leg of the final of the Copa Libertadores 2018 between CA Boca Juniors and CA River Plate to be played in the stadium Santiago Bernabéu on 9 December 2018 in Madrid, following the decision of the Cámara de Apelaciones of CONMEBOL rejecting on 6 December 2018 the appeal and request of CA Boca Juniors to disqualify CA River Plate from the Copa Libertadores 2018.
The second leg of the final of the Copa Libertadores 2018 between the two teams of Buenos Aires was initially set to take place on 24 November 2018 at the home stadium of River Plate but was eventually cancelled after the Boca Juniors team bus was attacked on the way to the stadium Monumental. Following these incidents, the CONMEBOL authorities decided that the second leg of the final should be played on 9 December 2018 in Madrid.
CA Boca Juniors requested CONMEBOL to disqualify the club of River Plate from the Copa Libertadores 2018 but such request was rejected first by the Tribunal de Disciplina of CONMEBOL on 29 November 2018 and then by the the Cámara de Apelaciones on 6 December 2018.
On 7 December 2018, CA Boca Juniors filed an appeal at the CAS, together with an urgent request for provisional measures; such request for provisional measures was dismissed today. In its appeal, CA Boca Juniors requests that the decision of the Cámara de Apelaciones of CONMEBOL be set aside and that the club of River Plate be disqualified from the Copa Libertadores 2018. The merits of the appeal will be examined at a later stage by a CAS arbitral panel. The arbitration procedure is on-going with the exchange of written submissions.

EL TRIBUNAL ARBITRAL DEL DEPORTE (TAS) RECHAZA LA SOLICITUD URGENTE DE MEDIDAS PROVISIONALES PRESENTADA POR EL C.A. BOCA JUNIORS
El Tribunal Arbitral del Deporte (TAS por sus siglas en francés) ha rechazado la solicitud urgente de medidas provisionales presentada el día de ayer por C.A. Boca Juniors con la que solicitaba la suspensión del partido de vuelta de la final de la Copa Libertadores 2018 entre C.A. Boca Juniors y C.A. River Plate que se disputará el 9 de diciembre de 2018 en el estadio Santiago Bernabéu en Madrid, una vez recibida la decisión de la Cámara de Apelaciones de la CONMEBOL de 6 de diciembre de 2018 que rechazaba la apelación del CA Boca Juniors y su solicitud de que el C.A. River Plate sea descalificado de la Copa Libertadores 2018.
El partido de vuelta de la final de la Copa Libertadores 2018 entre estos dos equipos de Buenos Aires estaba inicialmente programado para el 24 de noviembre de 2018 en el estadio del C.A. River Plate pero tuvo que ser pospuesto por el ataque que sufrió el bus del C.A. Boca Juniors en su camino al estadio Monumental. A la luz de estos incidentes, las autoridades de la CONMEBOL decidieron que el partido de vuelto de la final de la Copa Libertadores 2018 debía disputarse el 9 de diciembre de 2018 en Madrid, España.
C.A. Boca Juniors solicitó a la CONMEBOL que descalificará al C.A. River Plate de la Copa Libertadores 2018 pero dicha solicitud fue rechazada en primera instancia por el Tribunal de Disciplina de la CONMEBOL el 29 de noviembre de 2018 y posteriormente por la Cámara de Apelaciones de la CONMEBOL el 6 de diciembre de 2018.
El 7 de diciembre de 2018, C.A. Boca Junior presentó una apelación ante el TAS, junto a una solicitud urgente de medidas provisionales; Dicha solicitud ha sido rechazada en fecha de hoy. Con su apelación, el C.A. Boca Juniors solicita que se revoque la decisión de la Cámara de Apelaciones de la CONMEBOL y que el CA River Plate sea descalificado de la Copa Libertadores 2018. Los fundamentos jurídicos de la apelación serán analizados con posterioridad por una Formación Arbitral del TAS. El procedimiento arbitral seguirá su curso con el intercambio de escritos.
