Marathon Swimming: The appeal of Aurelie Muller is dismissed

19 August 2016 – The ad hoc Division of the Court of Arbitration for Sport (CAS) at the Olympic Games Rio 2016 rejected the appeal of the French swimmer Aurélie Müller who challenged her disqualification from the 10km-race by the International Swimming Federation (FINA) on 15 August 2016, following an incident at the end of the race.

The CAS Panel in charge of this matter retained jurisdiction but rejected the appeal. It has considered that the dispute was related to a “field-of-play decision” which, according to long standing CAS jurisprudence, is unable to be reviewed by CAS except in the event that there has been arbitrariness or bad faith in arriving at such decision, which was not proven in the present case.

The full award with the grounds will be published on the CAS website as soon as it will be available.

NATATION 10 KM : L’APPEL D’AURELIE MULLER EST REJETE

19 août 2016 – La Chambre ad hoc du Tribunal Arbitral du Sport (TAS) aux Jeux Olympiques de Rio 2016 a rejeté l’appel de la nageuse française Aurélie Müller qui contestait sa disqualification de la course des 10 km par la Fédération Internationale de Natation (FINA) le 15 août dernier, suite à un incident en fin de course.

La Formation du TAS en charge de cette affaire a admis sa compétence pour examiner ce cas mais a rejeté l’appel. Elle a estimé que le litige portait sur l’interprétation d’une « décision technique » qui, selon la jurisprudence constante du tribunal, ne peut pas être revue par le TAS sauf dans les cas où ces décisions sont prises de manière arbitraire ou de mauvaise foi, ce qui n’a pas été démontré dans le cas présent.

La sentence motivée sera publiée sur le site internet du TAS dès qu’elle sera disponible.
