The CAS rejects Serbian FA appeal, upholds in part the Albania FA appeal

10 July 2015 – The Court of Arbitration for Sport (CAS) issued its decisions today in two appeal arbitration procedures arising from the UEFA European Championship qualifying Group I match between Serbia and Albania in Belgrade on 14 October 2014 (the Match).

The Football Association of Albania (FAA) and the Football Association of Serbia (FAS) filed appeals at the CAS against decisions issued by UEFA Appeals Body in which both associations were disciplined further to incidents which occurred during the Match. The matter was heard at hearings which took place in Lausanne, Switzerland, on 16 and 17 April 2015. The parties, their legal counsel, experts and witnesses were heard by the Panel of CAS arbitrators in charge of each procedure.

The CAS has partially upheld the appeal filed by the FAA against the decision of the UEFA Appeals Body taken on 2 December 2014, in which the decision taken by the UEFA Control, Ethics and Disciplinary Body (UEFA CEDB) on 23 October 2014 was confirmed.

Pursuant to the UEFA decisions, the awarding of a forfeit against the FAA was based on the purported refusal of the Albanian team to resume the match after it was stopped by the referee at the 41st minute when a number of flares were thrown on the pitch by Serbian fans. During this stoppage, several incidents occurred and in particular around 15 Serbian fans invaded the pitch and violently attacked the Albanian players.

However, the CAS Panel found that the evidence did not reveal that the FAA refused to play following an order issued by the referee. The CAS Panel was unable to ascertain to its comfortable satisfaction that the referee issued a clear, direct and unconditional order to the players to resume the match on the basis of a definite decision that safety had been assured.

The Panel found that the match stoppage and the eventual abandonment of the match were caused by security lapses of the organizers and acts of violence exerted on the Albanian players by the Serbian fans and at least one security steward. As such, the Panel holds that the Football Association of Serbia (FAS) and not the FAA must be considered as responsible for the match not being played in full, in violation of Article 27.01 of the Regulations of the UEFA European Football Championship 2014-2016. In light of this finding, the CAS Panel has decided that the UEFA European Championship qualifying Group I match between Serbia and Albania be deemed to have been forfeited by the FAS by the score of 0:3.

The CAS went on to find, in line with UEFA, that the FAA was responsible for the drone operated during the match, carrying a banner depicting Albanian nationalistic and patriotic symbols, and confirmed the fine of EUR 100,000 imposed on the FAA.

Furthermore, with respect to the appeal filed by the FAS, the CAS has dismissed the appeal and confirmed the decision taken by the UEFA Appeals Body on 2 December 2014. Accordingly, the sanctions ordered by the UEFA CEDB in its decision dated 23 October 2014 are confirmed, namely:

(i) the FAS is deducted three points for the current UEFA European Championship qualifiers; (ii) the FAS is ordered to play its next two UEFA competition matches as host team behind closed doors; and (iii) the FAS is fined EUR 100,000.

The arbitral awards will be published on the CAS website in due course.

10 juillet 2015 – Le Tribunal Arbitral du Sport (TAS) a rendu ses décisions aujourd'hui dans le cadre de deux procédures arbitrales d'appel faisant suite au match qualificatif pour le Championnat d'Europe UEFA (Groupe I) entre la Serbie et l'Albanie à Belgrade le 14 octobre 2014.

La Fédération albanaise de football (FAF) et la Fédération serbe de football (FSF) ont déposé des appels au TAS contre les décisions rendues par l'Instance d'appel de l'UEFA dans lesquelles les deux fédérations ont été sanctionnées suite à des incidents qui se sont produits durant le match. Pour cette affaire, deux audiences ont eu lieu à Lausanne, Suisse, les 16 et 17 avril 2015. Les parties, leurs avocats, experts et témoins ont été entendus par les Formations arbitrales du TAS nommées dans chacune des procédures.

Le TAS a partiellement admis l'appel déposé par la FAF contre la décision de l'Instance d'appel de l'UEFA rendue le 2 décembre 2014, qui confirmait la décision prise par la Commission de contrôle d'éthique et de discipline de l'UEFA le 23 octobre 2014.

Selon les décisions de l'UEFA, le forfait retenu contre la FAF était fondé sur un éventuel refus de l'équipe albanaise de reprendre le match après qu'il a été interrompu par l'arbitre à la 41e minute, lorsque des fusées éclairantes ont été lancées sur le terrain par des fans serbes. Au cours de cette interruption, plusieurs incidents se sont produits et, plus particulièrement, environ 15 fans serbes ont envahi le terrain et ont violemment attaqué les joueurs albanais.

Toutefois, la Formation du TAS a considéré que les preuves au dossier ne permettaient pas de conclure que la FAF avait refusé de jouer suite à un ordre émis par l'arbitre. La Formation du TAS n'a pas pu établir avec certitude que l'arbitre avait donné un ordre clair, direct et inconditionnel aux joueurs de reprendre le match sur la base d'une décision précisant que la sécurité était garantie.

La Formation a considéré que l'interruption du match, puis son abandon, avait été causé par des défaillances sur le plan de la sécurité commises par les organisateurs et par des actes de violence perpétrés sur des joueurs albanais par des fans serbes et par au moins un steward responsable de la sécurité. De ce fait, la Formation du TAS a retenu que la FSF et non la FAA devait être considérée comme étant responsable du fait que le match n'ait pas pu aller à son terme, en violation de l'article 27.01 du Règlement du Championnat d’Europe de Football UEFA 2014-2016. En conséquence, la Formation du TAS a décidé que le match qualificatif du groupe I pour le championnat d'Europe de l'UEFA entre la Serbie et l'Albanie devait être considéré comme étant perdu par forfait par la FSF sur le score de 0-3.

Le TAS a ensuite confirmé, comme l'UEFA précédemment, que la FAF était responsable pour le drone déployé au cours du match, portant une bannière décrivant des symboles nationalistes et patriotiques albanais, et a confirmé l'amende de EUR 100’000 imposée à la FAF.

Enfin, concernant l'appel déposé par la FSF, le TAS a rejeté cet appel et a confirmé la décision prise par l'Instance d'appel de l'UEFA le 12 décembre 2014. Par conséquent, les sanctions ordonnées par la Commission de contrôle d'éthique et de discipline de l'UEFA dans sa décision du 23 octobre 2014 sont confirmées, à savoir : 1) déduction de trois points dans le cadre du tour qualificatif pour le championnat d'Europe UEFA; 2) les deux prochains matchs officiels de compétitions UEFA joués à domicile à huis clos ; et 3) amende de EUR 100’000.
