The Court of Arbitration for Sport (CAS) Ad Hoc Division registers more new cases

Tokyo, 2 August 2021 – The Ad Hoc Division of the Court of Arbitration for Sport (CAS) has registered the following new applications:

CAS OG 20/12 Nazar Kovalenko v. World Athletics (WA) & Athletics Integrity Unit (AIU)

The Ukrainian racewalker Nazar Kovalenko filed an application on 1 August 2021 seeking to overturn the AIU’s decision to declare him ineligible to compete in the Olympic Games Tokyo 2020 due to an alleged failure to meet the requirements of Rule 15 of the WA Anti-Doping Rules (missed out of competition doping tests), and an order that WA, AIU and/or the International Olympic Committee (IOC) take all reasonable measures to facilitate his participation in the 20km Race Walking event at the Olympic Games Tokyo 2020, scheduled for 5 August 2021. The Panel of arbitrators appointed to decide this dispute will hold a hearing with the parties on 3 August 2021.

CAS OG 20/13 Krystsina Tsimanouskaya v. National Olympic Committee (NOC) of Belarus

The Belarusian sprinter Krystsina Tsimanouskaya filed an urgent application and request for provisional measures in the morning of 2 August 2021 seeking to overturn the decision taken by the NOC of Belarus not to let her participate in the Women’s 200m qualifying event at the Tokyo 2020 Olympic Games.

The urgent request to stay the execution of the challenged decision was dismissed by the President of the CAS Ad hoc Division, as the athlete was not able to prove her case to get an interim relief.

TAS OG 20/14 Mourad Aliev & Fédération française de boxe & Comité National Olympique et Sportif Français c. IOC Boxing Task Force & Frazer Clarke & British Olympic Association

The French boxer Mourad Aliev filed an application on 2 August 2021 in relation to the decision taken by the referee to disqualify him from the Men’s super heavy 1⁄4 final with the British boxer Frazer Clarke at the Olympic Games Tokyo 2020. Mourad Aliev seeks the annulment of the referee’s decision to disqualify him as well as of the decision taken by the Director of the IOC Boxing Task Force which confirmed the first decision, and a ruling that bout 221 of Session 17 of the Men’s boxing competition be authorised to recommence from the beginning of the second round, with a different referee and judges. The Panel of arbitrators appointed to decide this dispute will hold a hearing with the parties in the evening of 2 August 2021 and issue the final decision as soon as possible thereafter.
