The Court of Arbitration for Sport (CAS) reduces the sanctions of the players Enrique Luis Triverio and Pablo Cesar Aguilar Benitez

The Court of Arbitration for Sport (CAS) has issued its decision in the appeals filed by the players Enrique Luis Triverio (Argentina) and Pablo Cesar Aguilar Benitez (Paraguay/Mexico) against the decisions issued by the Appeal Committee of the Mexican Football Federation (FMF) on 13 March 2017 in which they were sanctioned with one-year suspensions further to incidents in two separate matches wherein each player was accused of misconduct towards the referee.

CAS has annulled the decisions taken by the Appeal Committee of the FMF on 13 March 2017 and replaced them with new decisions, reinstating the original sanctions imposed by the Disciplinary Committee of the FMF; namely

• A suspension of eight (8) matches and a fine of 1,000 UMAs is imposed on Enrique Luis Triverio
  
  
• A suspension of ten (10) matches and a fine of 1,000 UMAs is imposed on Pablo César Aguilar Benítez

The match-suspensions already served by the players are to be credited against the sanctions imposed by the CAS.

On or around the 85th minute of the match between Club Toluca and Club Atlético Monarcas Morelia on 8 March 2017, the referee sent-off two Toluca players successively (both for a second yellow card). Enrique Triverio (Toluca) approached the referee and made contact with his hand on the referee’s chest. The referee immediately showed a straight red card to Triverio.

Upon having blown the whistle to end the match between Club Tijuana Xoloitzcuintles de Caliente and Club de Fútbol América on 8 March 2017, the referee was vigorously approached by Pablo Aguilar (America) and there was a contact between the two caused by the player. Also in this situation, the referee immediately showed a straight red card to the player.

The FMF has then initiated two disciplinary procedures against both players, which led to the decisions rendered first by the Disciplinary Committee and later by the Appeal Committee of the FMF.

The players filed their appeals with the CAS on 30 March 2017. While the two incidents were completely separate, the Appeal Committee of the FMF issued a single decision dealing with both cases and the two arbitrations were then consolidated before the CAS. Considering that the players were currently suspended, the parties agreed to proceed on an expedited basis. The Sole Arbitrator in charge of the procedures held a hearing in Lausanne, Switzerland on 28 April 2017 in the presence of the players, the FMF and their legal representatives.

The Sole Arbitrator considered that, in light of the evidence which was produced, the sanctions that had been imposed in the first instance by the Disciplinary Committee of the FMF were appropriate in light of the misconducts at stake and that the increased sanctions imposed by the Appeal Committee of the FMF could not be upheld.

EL TRIBUNAL ARBITRAL DEL DEPORTE (TAS) REDUCE LAS SANCIONES DE LOS JUGADORES ENRIQUE LUIS TRIVERIO Y PABLO CESAR AGUILAR BENITEZ

 El Tribunal Arbitral del Deporte (TAS) ha emitido su decisión en las apelaciones presentadas por los jugadores Enrique Luis Triverio (Argentina) y Pablo César Aguilar Benítez (Paraguay/Mexico) contra las decisiones emitidas por la Comisión de Apelaciones de la Federación Mexicana de Fútbol Asociación A.C. (FMF) el 13 de marzo de 2017 por las cuales se les sancionaba con un año de suspensión tras los incidentes que tuvieron lugar en dos partidos diferentes, en los cuales cada uno de los jugadores fue acusado de mala conducta hacia el árbitro.

El TAS revoca las decisiones emitidas por la Comisión de Apelaciones de la FMF y las remplaza por nuevas decisiones, que reinstauran las sanciones originales impuestas por la Comisión Disciplinaria de la FMF, a saber:

• Se sanciona a Don Enrique Luis Triverio con una suspensión de ocho (8) partidos y la imposición de una multa de 1.000 UMAs.
  
  
• Se sanciona a Don Pablo César Aguilar Benítez con una suspensión de diez (10) partidos y la imposición de una multa de 1.000 UMAs.

Los partidos no disputados por los jugadores serán deducidos de las sanciones impuestas por el TAS.

Sobre el minuto 85 del partido entre el Club Toluca y el Club Atlético Monarcas Morelia del 8 de marzo de 2017, el árbitro expulsó sucesivamente a dos jugadores del Toluca (ambos por segunda tarjeta amarilla). Enrique Triverio (Toluca) se acercó al árbitro y le tocó en el pecho con su mano. El árbitro mostró inmediatamente una tarjeta roja directa a Triverio.

En el momento en que el árbitro silbó el final del partido entre el Club Tijuana Xoloitzcuintles de Caliente y el Club de Fútbol América del 8 de marzo de 2017, Pablo Aguilar (América) se le acercó vigorosamente y hubo contacto entre ambos, causado por el jugador. En este caso el árbitro también mostró inmediatamente una tarjeta roja directa al jugador.

La FMF inició entonces dos procedimientos disciplinarios contra ambos jugadores, que dieron como resultado las decisiones emitidas en primer lugar por la Comisión Disciplinaria y seguidamente por la Comisión de Apelaciones de la FMF.

Los jugadores presentaron sus apelaciones ante el TAS el 30 de marzo de 2017. A pesar de que se trata de dos incidentes separados, la Comisión de Apelaciones de la FMF emitió una única decisión para ambos casos y los dos arbitrajes se consolidaron ante el TAS. Teniendo en cuenta que los jugadores estaban suspendidos en el momento de la apelación, las partes acordaron proceder de manera expedita.El Árbitro Único a cargo de los procedimientos celebró una audiencia en Lausana, Suiza, el 28 de abril de 2017, a la que asistieron los jugadores, la FMF y sus representantes legales.

El Árbitro Único consideró que, en vista de las pruebas aportadas, las sanciones impuestas en primera instancia por la Comisión Disciplinaria de la FMF eran apropiadas teniendo en cuenta las malas conductas en juego y que el aumento de las sanciones impuesto por la Comisión de Apelaciones de la FMF no podía ser ratificado.
