USADA v. Ryan Bailey

The Court of Arbitration for Sport (CAS) has upheld the appeal filed by the United States Anti-Doping Agency (USADA) against the American bobsledder Ryan Bailey. The first instance decision issued by the American Arbitration Association (AAA) in July 2017 in which Ryan Bailey was sanctioned with a six-month period of ineligibility following a positive antidoping control for dimethylbutylamine is set aside. The challenged decision is replaced by the CAS decision in which Ryan Bailey is sanctioned with a two-year period of ineligibility, commencing on 30 November 2017, less the period of suspension already served by the athlete.

In 2016, the former track and field sprinter began competing in the sport of bobsleigh and in January 2017 took part in the 2-man and 4-man bobsled competitions held at the International Bobsleigh and Skeleton Federation (IBSF) North American Cup, held in Park City, Utah, USA. Laboratory analysis of a sample provided after his first place finish in the 2-man bobsleigh competition on 10 January 2017 revealed the presence of dimethylbutylamine, a prohibited stimulant on the World Anti-Doping Agency Prohibited List.

In July 2017, a AAA Panel issued an award imposing a six-month sanction on the athlete. On 14 September 2017, USADA filed an appeal at CAS against the AAA decision.

The appeal was referred to a Panel of CAS arbitrators which held a hearing with the parties on 29 November 2017 in Los Angeles, USA.

The CAS Panel found that the athlete was guilty of an anti-doping rule violation and determined that the appropriate sanction was a two-year period of ineligibility, commencing on 30 November 2017 with credit given for the period of suspension already served by the athlete between 29 January and 9 July 2017. Furthermore, any results achieved by Ryan Bailey between 10 January and 29 January 2017 will be disqualified.
